What Does a Notary Public Do?

Documents for Overseas Use

Many documents intended for use overseas require more than ordinary witnessing or certification.

Depending on the country and the purpose of the document, a Notary Public may be required to verify a signature, certify a copy of a document, authenticate the identity or authority of a person signing a document, or prepare a notarial certificate.

Requirements vary between countries and documents. It is therefore important to establish what the overseas authority requires before the document is notarised.

Overseas Powers of Attorney and Property Documents

A Notary Public may be required to witness or notarise a Power of Attorney prepared for use overseas. Russell Kelly & Associates does not prepare foreign Powers of Attorney, but can provide notarial services for appropriately prepared documents where required.

Notarial services may also be required for documents concerning overseas property transactions, deceased estates, companies and other international legal or commercial matters.

Apostilles and Authentication

After a document has been notarised, it may also need to be legalised before it can be accepted overseas.

In Australia, Apostilles and Authentications are issued by the Department of Foreign Affairs and Trade (DFAT).

Whether an Apostille, Authentication or further consular legalisation is required depends on the destination country and the type of document involved.

Should I send my documents before the appointment?

Yes. Sending the documents in advance allows us to review what the overseas authority requires, identify the likely notarial steps and provide information about the appointment and likely fees.

Can Russell Kelly & Associates prepare a foreign Power of Attorney?

We do not prepare foreign Powers of Attorney. We can provide notarial services for an appropriately prepared document where notarisation is required.

Will my notarised document also need an Apostille or Authentication?

It may. The requirement depends on the destination country, the document and the receiving authority. In Australia, Apostilles and Authentications are issued by DFAT after the relevant document has been notarised where required.
