Certificates of Title and eConveyancing in NSW

New South Wales no longer issues paper Certificates of Title for land registered under the Torrens Title system.

Paper Certificates of Title were abolished on 11 October 2021 as part of the transition to electronic land dealings and eConveyancing in NSW.

What Happened to Paper Certificates of Title?

From 11 October 2021, existing Certificates of Title ceased to have legal effect and NSW Land Registry Services stopped issuing new paper Certificates of Title.

The Torrens Title Register maintained by NSW Land Registry Services remains the authoritative record of ownership and registered interests affecting land.

How Is Ownership Confirmed?

Ownership and registered interests can now be confirmed by obtaining a current title search rather than relying on possession of a paper Certificate of Title.

A title search can show the registered proprietor and interests recorded on the title, such as mortgages, easements, covenants and other dealings.

Electronic Land Dealings in NSW

Real Property Act dealings in NSW are generally lodged electronically through an Electronic Lodgment Network by an authorised subscriber, such as a solicitor, licensed conveyancer, financial institution or government body.

Electronic conveyancing allows documents and settlement information to be prepared, signed, lodged and completed electronically as part of the property transaction process.

What Does This Mean for Buyers and Sellers?

Buyers and sellers no longer receive or hand over a paper Certificate of Title as part of an ordinary conveyancing transaction.

Instead, solicitors and conveyancers undertake the necessary title searches, identity verification, client authorisation, electronic lodgment and settlement steps required for the transaction.
